Terms and Conditions

Please read these Terms and Conditions carefully before booking. This document forms a binding contract between you, the client (hereafter "the Client"), and Twist Surf (hereafter "the Company").

By completing a booking form and paying a deposit, the Client confirms they have read, understood, and agree to be bound by these Terms and Conditions.

1. Booking and Contract

1.1. To secure a booking, the Client must complete the booking form and pay a non-refundable deposit. The deposit consists of 15% of the total trip price plus a mandatory tax of €12 per person.

1.2. The booking is considered definite only when the deposit has been received by the Company. At this point, a binding contract between the Company and the Client comes into existence.

1.3. The Company will issue a Trip Confirmation email once payment is confirmed.

1.4. The Company reserves the right to decline any booking at its discretion before the contract comes into force.

2. Payment

2.1. The remaining balance of 85% of the total booking value is due upon arrival at the camp.

2.2. Any additional services or products purchased on-site must be paid for at the time of purchase or as otherwise instructed by camp management.

2.3. All prices are quoted and payable in the currency specified at the time of booking.

3. Cancellation Policy

3.1. Cancellation by the Client

If the Client wishes to cancel their booking, refunds on the paid deposit are issued as follows:

  • 30 days or more before your arrival: 75% refund of the deposit.
  • 29 to 15 days before your arrival: 50% refund of the deposit.
  • Cancellation less than 15 days before your arrival, or during your stay: No refund will be issued.

All cancellations must be made in writing and sent to the Company’s official email address.

3.2. Cancellation by the Company

The Company reserves the right to cancel any trip due to circumstances beyond our control, such as natural disasters, political instability, or other external events that make it unviable or unsafe to operate. In such a case, the Company will offer a full refund of the trip price paid to the Company. The Company is not responsible for any incidental expenses the Client may have incurred, such as flights, visas, or non-refundable travel arrangements.

4. Changes to Booking

4.1. Booking Amendments: If the Client wishes to change their booking (e.g., change dates), they must contact the Company in writing as soon as possible. The Company will try to accommodate requests, subject to availability. Surcharges may apply.

4.2. Client Substitution: If the Client is prevented from travelling, they may transfer their booking to another suitable person, provided that written notice is given at least 30 days prior to arrival. An administration fee may be charged for this service. The new Client must accept these Terms and Conditions.

5. Travel Insurance

5.1. Travel insurance is mandatory for all Clients. It is the Client's sole responsibility to arrange their own comprehensive travel insurance.

5.2. The insurance must cover, at a minimum: personal accident, medical expenses, emergency evacuation and repatriation, trip cancellation or curtailment, and loss or damage of personal effects.

5.3. Crucially, the policy must explicitly cover adventurous activities, including surfing.

5.4. The Client’s personal property, including baggage and equipment, is at all times their own risk.

6. Passports, Visas, and Health

6.1. It is the Client's responsibility to be in possession of a valid passport, visa permits, and any required vaccinations or preventative medicines for the duration of the trip.

6.2. The Client must inform the Company of any pre-existing medical conditions, allergies, or dietary restrictions that could affect their participation in camp activities.

7. Inherent Risks and Assumption of Risk

7.1. The Client acknowledges that surfing and related activities are inherently dangerous and involve risks above and beyond those of a conventional holiday. These risks can result in serious injury or death.

7.2. The Client acknowledges that the ocean, weather, and surf conditions are unpredictable and can change rapidly.

7.3. While the Company’s guides and instructors will take measures to reduce risks, they cannot eliminate them. The Client must accept these inherent risks and take responsibility for their own actions and safety. It is the Client's responsibility to not surf in conditions beyond their capability.

7.4. The Client acknowledges that travel in Morocco may expose them to different standards of safety, hygiene, transport, and infrastructure than they are used to.

7.5. By agreeing to these terms, the Client accepts these risks and agrees to release the Company from any liability connected to them.

8. Release of Liability, Waiver of Claims, and Indemnity Agreement

8.1. In consideration of participating in a trip with the Company, the Client agrees to waive any and all claims against and to release the Company (and its directors, employees, agents, and contractors) from any and all liability for any loss, damage, expense, or injury, including death, that the Client may suffer as a result of their participation, due to any cause whatsoever, including negligence, breach of contract, or breach of any statutory duty of care on the part of the Company.

8.2. The Client agrees to hold harmless and indemnify the Company from any and all liability for property damage or personal injury to any third party resulting from their participation in the trip.

8.3. This agreement shall be effective and binding upon the Client's heirs, next-of-kin, executors, administrators, and representatives.

9. Guest Code of Conduct

9.1. The Client agrees to accept the authority of the Company's leaders and local operators at all times.

9.2. The Client is expected to behave in a manner that is respectful of other guests, staff, the local community, and the environment.

9.3. The Client will be held financially responsible for any damage they cause to the Company’s property or equipment.

9.4. The Company reserves the right to remove any Client from a trip, without refund, if their behavior is deemed illegal, dangerous, or disruptive to the well-being of others.

10. Media Release

The Client agrees that the Company may use photographic or video images of the Client taken during their stay for promotional and marketing purposes (e.g., on its website, social media) without any charge or right to compensation. A Client who does not wish to have their image used must notify the Company in writing.

11. Data Security and Privacy

The Company collects personal information for booking and operational purposes only. We are committed to protecting your privacy and guarantee that no information will be sold or passed on to any third party without your prior consent. Credit card and payment information is processed by a secure, certified third-party payment gateway and is not stored by the Company.

12. Governing Law and Jurisdiction

This contract and all matters arising from it shall be governed by and interpreted in accordance with the laws of the Kingdom of Morocco. Any litigation shall be brought solely within Morocco and shall be within the exclusive jurisdiction of the Courts of Agadir, Morocco.
